Who Qualifies for Maternity and Paternity Leave

Private sector expats working under a MOHRE-issued work permit are covered by the 2026 leave rules. You must have completed at least one year of continuous service with the same employer to receive full paid maternity leave. Shorter-service employees still qualify for unpaid leave. Both parents must notify their employer in writing at least 30 days before the expected due date.

Maternity Leave Duration and Pay

Mothers receive 60 calendar days of fully paid maternity leave. The first 45 days are paid at 100 percent of basic salary; the next 15 days are paid at 50 percent. Leave can start up to 30 days before the expected delivery date. If medical complications arise, an extra 45 days of unpaid leave may be granted with a medical certificate from a DHA- or DOH-approved facility.

Paternity Leave Entitlements

Fathers are entitled to five working days of paid paternity leave to be taken within six months of the child’s birth. The leave is calculated on basic salary and does not reduce the employee’s annual leave balance. Employers may request the birth certificate issued by the UAE health authority as proof.

Additional Protections for Parents

• Breastfeeding mothers may take one paid hour per day for up to 18 months after returning to work.
• Employers cannot terminate a contract during maternity leave or for six months afterward except in cases of gross misconduct proven through MOHRE channels.
• Both parents keep full health insurance coverage through the employer during leave periods.

How to Apply and Notify Your Employer

Submit a written request via the company HR portal or email at least 30 days before the due date. Attach the medical report from a licensed UAE clinic. After delivery, upload the birth notification issued by the hospital to complete the MOHRE record. Keep copies of all documents for your personal file.

Common Questions from Expats

Contract workers on limited-term visas receive the same leave as unlimited-contract staff. If both parents work for the same employer, each parent claims their own entitlement separately. Leave balances reset with each new child and do not carry forward.
