2026 Maternity Leave Entitlement
From January 2026, MOHRE updated the private-sector maternity leave rule. All female employees covered by the UAE Labour Law receive 70 calendar days of paid maternity leave. The first 45 days are paid at 100 percent of basic salary, and the next 25 days at 50 percent. The leave can start up to 30 days before the expected delivery date.
Who Qualifies
The rule applies to all women working under a private-sector contract in Dubai, regardless of nationality. You must have completed at least one year of continuous service with the same employer to receive full pay for the first 45 days. Employees with less than one year still receive the 70 days, but the pay rate is adjusted proportionally.
Adding Unpaid Leave
After the 70 paid days, you can request an additional 45 days of unpaid maternity leave. The employer must approve this request if you provide a medical certificate. You may also combine accrued annual leave with maternity leave, giving up to 115 days away from work in total.
How to Apply
Submit a written request to your HR department at least 30 days before your expected due date. Attach a medical report from a DHA-licensed facility confirming the pregnancy and expected delivery date. Your employer must reply within seven working days. Once approved, MOHRE records the leave through the Ministry’s online portal, and your salary during leave is processed through WPS.
Return-to-Work Protections
Your job and benefits remain protected during maternity leave. Employers cannot terminate your contract because of pregnancy or maternity leave. You are also entitled to one hour of paid nursing break per day for six months after returning to work.
